These Terms of Service (“Terms”) govern access to and use of Scriblet, a service owned and operated by FM3048 LLC (“FM3048,” “Scriblet,” “we,” “us,” or “our”). By creating an account, purchasing a subscription, or using Scriblet, you agree to these Terms.
Scriblet helps organizations collect information from multiple contributors, interpret natural-language messages, organize information according to customer-defined structures, and prepare information for presentation or other use.
Scriblet may change, improve, suspend, or discontinue portions of the Service as the product develops.
Customers are responsible for maintaining accurate account information and for safeguarding account credentials. Customers are responsible for activity conducted through their accounts and for ensuring that people they authorize to use Scriblet comply with these Terms.
“Customer Content” means information, messages, schedules, documents, names, dates, assignments, and other content submitted to or generated within Scriblet for a customer's use.
Customer Content belongs to the customer. FM3048 does not claim ownership of Customer Content.
By using Scriblet, the customer grants FM3048 a limited, non-exclusive right to access, process, store, transmit, reproduce, and otherwise use Customer Content as reasonably necessary to provide, secure, maintain, and support Scriblet.
Scriblet uses artificial intelligence to interpret natural-language information. Scriblet is designed to confirm its understanding and ask for clarification when information is unclear, but AI-generated interpretations may still contain errors.
Customers are responsible for reviewing important information and outputs before relying on them, publishing them, distributing them, or using them for consequential decisions.
Scriblet offers a text messaging program that lets contributors send updates to their organization's data and receive replies and account alerts. All messages are sent by Scriblet.
Scriblet assigns each organization a Scriblet number and emails it to a contributor when that person is added by the organization's administrator. To opt in, the contributor texts START to that number. Message frequency varies. Message and data rates may apply. For help, text HELP or contact support@scriblet.io. To opt out, text STOP at any time; this stops all messages from Scriblet, including replies to messages sent to Scriblet. To opt back in, text START. Carriers are not liable for delayed or undelivered messages.
Scriblet may also send messages to contributors and customers as part of the Service, including requests for information, confirmations, clarification questions, corrections, schedules, and other service communications.
The customer is responsible for ensuring that it has the authority and any legally required consent to provide contact information and authorize communications through Scriblet. Standard carrier or messaging charges may apply.
Scriblet assigns each organization a Scriblet-owned phone number for routing contributor updates. The number remains Scriblet's property. Organizations may not publish, advertise, or distribute the number, and may not use it to send messages. Scriblet provides the number to contributors directly.
You may not use Scriblet to violate applicable law, infringe another person's rights, transmit malicious code, interfere with the Service, attempt unauthorized access, or use the Service in a manner that creates unreasonable security, legal, or operational risk.
Scriblet is offered through subscription plans. Applicable pricing, billing frequency, renewal terms, and cancellation procedures will be presented during signup or otherwise made available to the customer.
Unless otherwise stated, subscriptions may renew automatically until canceled. Customers remain responsible for charges incurred before cancellation becomes effective.
Payments may be processed by third-party payment providers. FM3048 may change subscription pricing with appropriate notice.
Scriblet is not intended to function as a permanent archive of Customer Content.
Date-specific or scheduled Customer Content will generally be retained until approximately 30 days after its associated date or scheduled use date. Scriblet will periodically identify and delete Customer Content whose associated date or scheduled use date is more than 30 days in the past.
Customer Content with a future scheduled date will not be deleted merely because it was entered more than 30 days ago. A schedule entered two years in advance may therefore remain available until approximately 30 days after the dates to which the schedule relates.
Certain information may be retained longer when reasonably necessary for account administration, billing, legal compliance, dispute resolution, fraud or abuse prevention, security, or another legitimate business purpose.
Customers may request deletion of their data by contacting support@scriblet.io, subject to applicable retention requirements.
Scriblet may use third-party providers, including providers for artificial intelligence, hosting, databases, communications, payments, security, analytics, and other infrastructure. Your use of Scriblet may therefore involve processing by these providers as necessary to provide the Service.
Scriblet, including its software, branding, interfaces, documentation, and underlying technology, is owned by FM3048 LLC or its licensors and is protected by applicable intellectual property laws. Except for the rights expressly granted in these Terms, no rights are transferred to the customer.
If you provide suggestions, ideas, or feedback about Scriblet, you grant FM3048 permission to use that feedback without restriction or compensation, provided that doing so does not disclose Customer Content or confidential information.
FM3048 will make reasonable efforts to keep Scriblet available, but does not guarantee uninterrupted or error-free operation. Service interruptions may occur because of maintenance, third-party services, technical failures, security events, or circumstances outside FM3048's reasonable control.
To the fullest extent permitted by law, Scriblet is provided on an “as is” and “as available” basis. FM3048 does not warrant that the Service will always be accurate, uninterrupted, secure, or suitable for every particular purpose.
To the fullest extent permitted by law, FM3048 will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to the Service.
To the fullest extent permitted by law, FM3048's total aggregate liability arising from or related to Scriblet will not exceed the greater of (a) the fees paid by the customer to FM3048 for Scriblet during the three months preceding the event giving rise to the claim or (b) $100.
To the fullest extent permitted by law, the customer agrees to defend, indemnify, and hold harmless FM3048 and its officers, employees, contractors, and agents from claims, damages, liabilities, costs, and expenses arising from the customer's unlawful use of Scriblet, violation of these Terms, or Customer Content where the customer's acts or omissions give rise to the claim.
FM3048 may suspend or terminate access to Scriblet if reasonably necessary to address security concerns, unlawful activity, abuse, nonpayment, material violation of these Terms, or other circumstances that threaten the Service or its users.
Customers may cancel their subscription according to the cancellation procedures provided by Scriblet.
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Subject to applicable law, disputes will be brought in courts located in or serving Johnson County, Texas.
FM3048 may update these Terms as Scriblet develops or as legal and operational requirements change. Updated Terms will be posted with a revised effective date. Where required by law, FM3048 will provide additional notice of material changes.
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the extent permitted by law. These Terms, together with applicable order forms or subscription terms and the Scriblet Privacy Policy, constitute the agreement governing use of the Service unless a separate written agreement applies.
